Terms and Conditions
We have stated a few terms and conditions below, for both parties to have peace of mind and security when renting/letting Maison Marcks. When booking, as the payment procedure is done, both parties (owner and guest) agree to the following:
Rental Payment / Cancellation policy
100% of rental fee payable upon agreement. Up until 5 days prior arrival date, guest will get fully reimbursed of rental fee (minus any transaction costs from PayPal or other bank) if wishing to cancel. For example: if your arrival date is 23rd January, you get full reimbursement until 23:59 on the 18th January. If the guest cancels after 5 days prior to the rental start date the Owner shall have the right to retain 100% of the rental fee.
Maintenance and Repairs
The Guest shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. The Guest shall pay for maintenance and repairs
should the premises be left in a lesser condition. The guest agrees that the Owner shall invoice the guest any costs of said services after inspection if the guest causes damage to the premises or its furnishings.
Use of Property
Guest expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guest do not intend to make the property a residence or household.
The Owner has the right to inspect the premises with prior notice as stated with the applicable laws. Should the Guest violate any of the terms of this agreement, the rental period shall be terminated immediately in accordance with law. The Guest waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the premises at the expiration time and date of this agreement.
Quiet Enjoyment
The Guest shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Guest shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and the Guest shall then immediately vacate the premises.
Pets / Smoking
No animals or pets of any kind will be brought onto the premises. Smoking is not allowed inside the home but allowed in the courtyard.
Possessions
Valuable items left behind by guest will be held for the guest and every reasonable effort will be made to contact the guest for return. If items are not claimed for longer than 6 months they shall become the property of the Owner. The Owner shall not be held liable for condition of said items.
Internet
High speed wireless internet is provided as a convience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
Shortened Stays and Conditions
There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.
Illegal Use
Guest shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits.
Owner’s Liability
The Guest and the guest’s company in the house shall hereby indemnify and hold harmless the Owner against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Owner may maintain on the property does not cover the personal property of the Guest, and that the Guest should purchase their own insurance for the Guest and their company if such coverage is desired.
Attorney’s Fees
Guest agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Owner enforcing this agreement.
